Thina Terms and Conditions of Use


1. Introduction


Welcome to Thina, a platform designed to connect volunteers, organizations, and communities. By accessing or using Thina, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using the app.


2. User Eligibility

  • Current Version (Beta): The current beta version of Thina is only available for individuals and organisations. All users must be 18 years or older.

  • Future Expansion: Thina plans to expand access to corporations and schools. In future versions, restricted access profiles will be available for students under 18, allowing them to engage with volunteering opportunities in a supervised capacity, as coordinated by their school or organization.

  • By creating an account, you agree to comply with all laws applicable in South Africa (including POPIA) and any applicable international laws (e.g., GDPR, if applicable in the future).


3. Account Registration

  • Users are required to provide accurate and current information (e.g., name, email address, phone number) when creating an account.

  • It is the user's responsibility to maintain the confidentiality of their account information and password.

  • You may update, view, or delete your account information at any time within the app.


4. Use of the App

  • Users (individuals, organisations, schools, corporations) can participate in volunteering activities, create events, track hours, and connect with others.

  • Prohibited behaviours include, but are not limited to, the use of offensive language, harassment, or any misuse of the platform that disrupts the community.

  • Thina reserves the right to remove or modify user content if it violates these terms or the spirit of the platform.


5. Payments and Subscriptions

 

  • Thina offers premium subscriptions for additional features, including detailed tracking for corporations and access to rewards for individuals.

  • Donations to organisations are not processed through Thina. Instead, users will be directed via an external link to the organisation's own donation page. Thina does not handle or take liability for any transactions made outside the platform.

  • Subscription fees are non-refundable unless otherwise specified under local consumer protection laws.


6. Data Collection and Privacy

 

  • Thina collects certain personal data (name, email, phone number, birth date, location, and calendar access) to facilitate volunteer connections and provide location-based services.

  • The data you provide will be shared with the organizations you volunteer with, and will also be visible to followers and friends on your profile (with your consent).

  • Thina complies with the Protection of Personal Information Act (POPIA) in South Africa. We do not sell or share your data with third parties, and all data is encrypted and securely stored.

7. Social Media and User-Generated Content

 

  • Users can post photos, share updates, and message one another on the app. By uploading content, you grant Thina a non-exclusive, royalty-free license to display and share your content within the app and through related social media channels (with your consent).

  • Thina is not liable for any photos taken or shared by users that may infringe on privacy or rights of third parties. You agree that all content you post complies with the law and does not infringe on the rights of others.

  • Followers and messaging features are enabled within the app. Users must comply with community guidelines regarding respectful communication and content sharing.

  • Thina reserves the right to block or remove users who engage in inappropriate behaviour.


8. Third-Party Links and Content

  • Thina may provide links to external websites for donations or more information about organizations. We are not responsible for the content, privacy policies, or practices of these third-party sites.

  • Users should exercise caution when following external links and are responsible for any transactions or actions taken outside the Thina platform.


9. Liability and Disclaimers

 

  • Participation in Events: By using Thina, you acknowledge that participation in volunteering activities is at your own risk. Thina serves as a hosting platform and does not assume responsibility for the safety, security, or conduct of individuals or organisations during events. We encourage volunteers to engage with registered nonprofit organisations, and you may view their registration documents and external links via the app where applicable.

  • Thina provides the platform "as-is" and makes no guarantees regarding the availability, security, or functionality of the app.

  • Thina is not liable for any issues that arise during volunteer activities (e.g., accidents, injuries) or from interactions between users and organizations. Volunteers engage in activities at their own risk.

  • Third-Party Liability: Thina is not responsible for the conduct, safety protocols, or legal standards of the organisations hosting the events. Users should verify the safety and authenticity of any events they participate in.

  • Thina is not responsible for any damages resulting from the use of external links, third-party websites, or user-generated content.

  • Users agree that all content shared on the platform is their responsibility, and Thina is not liable for any claims arising from the content they upload.


10. Termination of Accounts

  • Users can delete their accounts at any time through the app, and all data will be removed in compliance with our Data Retention Policy.

  • Thina reserves the right to suspend or terminate accounts that violate these terms or engage in prohibited behaviours.


11. Modifications to the Terms

  • Thina reserves the right to modify these Terms and Conditions at any time. Users will be notified of changes via email and an in-app notification.

  • Continued use of the app after changes to the terms constitutes acceptance of those changes.


12. Governing Law

  • These terms are governed by the laws of South Africa.

  • If Thina expands to other regions (EU, US, etc.), additional terms will be provided to comply with relevant laws.
